Terms and Conditions
Our contractual terms for using Our Tales
Last updated: December 4, 2025
§ 1 Scope and Provider
These General Terms and Conditions (hereinafter "Terms") apply to all orders and contracts concluded via the OurTales platform (hereinafter "Platform" or "Provider").
The provider of the platform and contractual partner is:
The offer is exclusively directed at consumers within the meaning of the Austrian Consumer Protection Act (KSchG).
§ 2 Subject Matter & AI Notice (Beta Phase)
OurTales offers a service for creating personalized children's books and stories. The creation of content (texts and illustrations) is automated using Generative Artificial Intelligence (AI).
Beta Phase: The user acknowledges that the platform is currently in a beta phase. This means that the software and AI models are still being optimized.
AI Disclaimer: Due to the technical nature of generative AI, in rare cases there may be:
- Inharmonious image details (e.g., artifacts in hands or faces),
- Logic errors in the narrative, or
- Deviations from user input.
These AI-typical characteristics do not constitute a defect in the product, provided that the story is understandable and usable at its core.
The provider owes the provision of the digital book (PDF) for download. A claim to physical delivery (hardcover) only exists if this was explicitly selected and paid for in the ordering process.
§ 3 Contract Conclusion
The presentation of products on the website does not constitute a legally binding offer, but an invitation to place an order.
By clicking the "Buy" button (or a corresponding clear wording), the customer submits a binding offer to conclude a purchase contract.
The contract is concluded as soon as the provider accepts the order by sending a confirmation email or by providing the service (download link or generation confirmation).
§ 4 Prices and Payment Terms
The prices stated on the website at the time of ordering apply. All prices are final prices including statutory VAT.
Payment is processed via the payment service provider Stripe. Accepted payment methods are displayed in the checkout process (e.g., credit card, Apple Pay, Google Pay).
§ 5 Delivery and Provision
Digital Products (PDF): Delivery is made by email (download link) or directly via the user account on the platform. Generation time may vary depending on server load (usually a few minutes up to 24 hours).
The provider is not liable for delivery problems due to incorrect entry of the email address by the customer or full email inboxes.
§ 6 Right of Withdrawal & Voluntary "Beta Guarantee"
Exclusion of statutory right of withdrawal: Since OurTales books are goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (personalized products), there is no statutory right of withdrawal pursuant to § 18 para. 1 no. 3 FAGG.
Digital edition: Every book includes a digital edition: digital content not supplied on a physical medium. The statutory right of withdrawal applies to it until the customer, when starting the creation of their book, expressly requests that the provider begin immediately and acknowledges that this ends their right of withdrawal for the digital edition (§ 18 (1) 11 FAGG). The provider confirms both by email at that moment.
Voluntary 30-Day Money-Back Guarantee:
Notwithstanding the statutory exclusion, the provider grants a voluntary money-back guarantee: if the customer is not satisfied with their book, they may contact support within 30 days of purchase. No reason need be given. The customer chooses between:
- a free regeneration of the book, or
- a full refund of the purchase price.
§ 7 Copyright and Usage Rights
Rights granted by the customer: The customer grants the provider the non-exclusive, worldwide right to use, edit, and have processed by AI services the images uploaded and texts entered by the customer (e.g., names, story details) for the purpose of contract fulfillment (generation of the book). The customer warrants that they have the necessary rights to the uploaded images.
Rights to the generated book: The provider grants the customer a simple, non-transferable right to private use of the generated digital book. Commercial use, redistribution, or resale of the generated content is prohibited without explicit written consent from the provider.
§ 8 Code of Conduct & Prohibited Content
The customer is prohibited from uploading content or creating story prompts that:
- violate applicable laws,
- are pornographic, racist, glorifying violence, or discriminatory,
- infringe the rights of third parties (copyright, personal rights).
The provider reserves the right to refuse generation if prohibited content is suspected and to block the user account. No refund will be made in this case.
§ 9 Liability
The provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
For slight negligence, the provider is only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the typical, foreseeable damage.
Data loss: The provider does not guarantee the permanent storage of generated books. The customer is advised to save the PDF locally immediately upon receipt.
§ 10 Data Protection
The processing of personal data is carried out in accordance with the privacy policy. The customer consents to the processing of their data (including transfer to AI service providers for generation).
§ 11 Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the customer is a consumer, mandatory protective provisions of the state in which the customer has their habitual residence remain unaffected.
The place of jurisdiction for all disputes is Vienna, to the extent permitted by law.
Should individual provisions of these Terms be invalid, the contract shall remain valid in all other respects.
